Pedica (IDV) Premesso che: con legge 27 maggio 1991, n. 176, l'Italia ha ratificato e dato esecuzione alla Convenzione internazionale sui diritti del fanciullo, stipulata a New York dai Paesi aderenti all'ONU il 20 novembre 1989; la predetta Convenzione, all'articolo 3, comma 1, recita:
"in tutte le decisioni relative ai fanciulli, di competenza sia delle istituzioni pubbliche o private di assistenza sociale, dei tribunali, delle autorità amministrative o degli organi legislativi, l'interesse superiore del fanciullo deve essere una considerazione preminente";

F., poiché la disposizione di allontanamento dalla madre V. P. presa dal giudice del Tribunale dei minori, dottor Ianniello , e le modalità di esecuzione della stessa hanno destato particolare clamore nella comunità di Sezze (Latina) dove il minore è residente;
per riassumere le vicende giudiziarie legate al caso di A. L. F. si rappresenta che, con provvedimento del May 20, 2009 No 8164 of 2009, Dr. Ianniello of the juvenile court in Rome has

the juvenile court, by decision No 1188 February 16, 2010, appointed a guardian ad litem, in the person of the lawyer Enrico Ronchini;
with decision No. 1678 March 2, 2010 Dr. Ianniello reinstating the parental rights of mother and by providing for the same person to accompany the child at the family home with an extended right of residence of the child with both parents;

F., avrebbe accolto il curatore che si è recato presso la sua abitazione per parlare con il bambino, e tuttavia lo stesso dottor Ronchini, dopo un tentativo di convincere il piccolo ad andare dal padre, durato più di due ore, ha desistito dal suo intento per il rifiuto espresso dal bambino;
con ordinanza del 13 aprile 2010, il dottor Ianniello disponeva then "on a provisional and urgent the immediate removal of the child (...) for placement in a foster home outside the territory of residence (...) suspended, the status of the relationship with the mother figure to facilitate the integration process;

il dottor Ianniello ha motivato le sue determinazioni imputando alla signora P. ed alla famiglia materna la responsabilità del "tentativo, fin qui riuscito, di escludere del tutto la figura paterna dalla vita del figlio" rilevando the need to stop "as soon as this sick relationship" between mother and child, forgetting that the last order issued provided the accompaniment of his mother at a family home, and not the father;

similar measures, moreover, would not be an exception, come sottolineato dalle molte interrogazioni presentate da diversi parlamentari su diversi giudici del Tribunale per i minori di Roma ; considerato, infine, che emerge ogni giorno che la struttura giudiziaria in questione soffre da tempo di una carenza di risorse finanziarie e di organico, la quale rischia di compromettere il funzionamento amministrativo del tribunale nonché la rapida conclusione dei procedimenti pendenti , si chiede di sapere:
se il Ministro in indirizzo non ritenga opportuno assumere, nell'ambito delle proprie competenze, iniziative, con riferimento a quanto descritto in premessa, al fine di verificare l'eventuale sussistenza di presupposti idonei a promuovere un'azione disciplinare.

what year was estimated expenditure on placements in the community or family homes arranged by the Juvenile Court of Rome whereas the cost to the state varies from 70 to 300 € per day for each child;
how many cases of placement in home famiglia vengano attuati annualmente in presenza di genitori idonei ma indigenti, visto che appare evidente che un contributo economico alla famiglia in difficoltà avrebbe costi molto inferiori del mantenimento dei figli minori in una comunità;
quanti siano infine gli affidi condivisi concessi nonostante uno dei genitori abbia subito condanne o non sia stato ritenuto idoneo dai periti del giudice;
se non si ritenga di dover intervenire urgentemente al fine di garantire alla Presidenza del Tribunale dei minori di Roma le risorse necessarie per assicurare non soltanto il funzionamento amministrativo della struttura, ma anche la definizione rapida dei processi, in quanto, se è vero che una giustizia veloce dovrebbe essere garantita to all citizens, this is even more necessary in the processes that affect children, given that the uncertainty arising from a judicial situation indefinite risks undermining the growth of the child permanently.
